Proposed NY DWI Law

New York Governor Patterson is pushing for new legislation that would raise the penalties for people who are convicted of New York drunk driving with a child in their car. Named the Child Passenger Protection Act, the proposed law makes it a felony for anybody to get a New York DWI with a child passenger. Other state, such as Arizona, already have strict felony classification for DUI drivers with child passengers which include jail time and a three year license revocation.

Also, under the proposed law if a child dies in a drunk driving incident New York’s felony murder law would come into effect. A person with a clean record would face 15 to 25 years in a New York State Prison.

Given the recent awareness of the real dangers of NY drunk driving to children, the law is expected to pass, making New York the 36th state with enhanced penalties or felony classification for DWI with a child in the vehicle.
