Stallworth Becomes Free Agent

08 02.10

After a year-long suspension for killing a pedestrian while driving drunk, Stallworth was reinstated Sunday by NFL commissioner Roger Goodell.

Goodell said Friday he met with Stallworth about a month ago, and the receiver is “in a better place than he was.” Goodell said Stallworth recognized what he did wrong and has prepared himself to return to the NFL.

Stallworth, 28, was charged with DUI manslaughter March 14 in an early morning accident that killed 59-year-old Mario Reyes, a Miami construction worker who was on his way home.

Stallworth’s blood-alcohol level after the crash was .126, well above Florida’s legal limit of .08, according to results of a blood test.

In mid-June, Stallworth was given a 30-day jail sentence, of which he served 24 days, and reached an undisclosed financial settlement with Reyes’ family. Two days after sentencing, the NFL suspended Stallworth indefinitely without pay.

Stallworth played just one season for the Browns after signing a seven-year, $35 million contract in 2008. That year he recorded 17 receptions for 170 yards in 11 games.

Monday’s release officially makes Stallworth an unrestricted free agent.

Florida Man in Wheel Chair Killed by Drunk Driver

28 12.09

Outside the home of 32-year-old Michael Leininger, people have left cards and flowers in his memory. While he was disabled, his friends say he lived life to the fullest.

Bob Godwin says even though his friend Michael Leininger had cerebal palsy and used a wheel chair, it never let him down. “He had a social life, friends, and cooked out a lot.”

However it all came to an end Saturday night. “He was killed last night by a drunk driver.” 48-year-old Thomas PItt was charged with DUI manslaughter and property damage.

Police say as Leininger crossed SR 50 and Key Largo Drive, Pitt hit him with his car. Investigators tell us, that Pitt had the green light, but Leininger was using the crosswalk.

Godwin’s fiancee Debbie Champagne also uses a wheel chair and was distraught over the death of her friend Michael. She says it’s scary trying to cross SR 50 and has a reminder for drivers especially as they get ready to celebrate the New Year; “Please don’t drink and drive and when you do, look out for the other people. The people in wheel chairs, the people on motorcycles.”

Godwin says it’s too late for their friend Michael. “Unfortunately Mike won’t be having a new year and he was looking forward to it.”

If Pitt is convicted of DUI manslaughter, he could face up to 15 years in prison. FHP troopers say, even if a driver has the green light, they must yield to a pedestrian in a crosswalk.

24 12.09

A 30-year-old Chicago man was charged with murder and aggravated DUI on Wednesday in a hit-and-run that killed a Rogers Park woman and injured her 6-year-old son.

Ralph Eubanks, of the 1400 block of North Sedgwick, also was charged with leaving the scene of an accident. Maria Worthon, 48, of the 1400 block of West Touhy, was walking with her son in the 1400 block of West Greenleaf at 9 p.m. Monday when they were struck by Eubanks’ car, Cook County prosecutors said.

He drove south on Greenview after hitting them, police said, but they stopped him about a mile away.

The boy was in critical condition Wednesday at Children’s Memorial Hospital.

Eubanks, a convicted felon, has been stopped for speeding, driving without a valid license and DUI in the past seven years, according to court files.

Obviously a DUI fatality is not taken lightly, but neither is a straight DUI. If you have been charged with a DUI in Chicago or anywhere for that matter you would be well advised to contact a DUI attorney.

15 Year Old Faces Florida DUI Manslaughter Charges

16 08.09

In March a 16 year old boy was killed by a 15 year old drunken female driver who had a blood alcohol level of .165, more than twice the legal limit in Florida.

The driver, of Naples, faces Florida DUI manslaughter charges and if convicted could face up to 15 years jail time.

“This will be a good test for the justice system in Florida,” said Arizona DUI Lawyer Stewart Bergman, who has handled serious vehicular crimes, including manslaughter. “When you look at the Stallworth sentence, it should give her attorneys a pretty compelling argument.”

Though Mr. Stewart has a point there are some things that make what this driver did worse than what NFL WR Donte Stallworth did.  First is the fact that her victim was young. Second is the fact that he put his trust in her. Third is the fact that she shouldn’t have been drinking at all. Fourth is the fact that she was not a licensed driver. And finally, according to reports by the Florida Highway Patrol, she was driving at 70 miles per hour in an 30-mph zone.

Bail May Be Revoked for Montco Woman Accused of DUI Manslaughter

18 05.09

Drunk Driving in Montgomery County, Pennsylvania.

Montgomery County prosecutors are asking a judge to revoke bail for a 23-year-old Newtown Square woman who is awaiting trial on charges she killed a woman on the blue route last year while she was driving drunk.

Prosecutors say Roisin O’Neill was on house arrest when a car she was riding in got stopped at a DUI checkpoint at 1:30 in the morning late last month. Several kids in the car were cited by police for underage drinking.

First Assistant DA Kevin Steele now wants the judge to send the Delaware County woman to jail.:

“She’s violated a trust that’s been placed in her and whatever factors you can look at to make that decision.”

But defense attorney Vince DiFabio says any interruption in therapy she’s receiving for a serious ankle injury would be a detriment to her recovery.

The judge suggested a compromise – jail on the weekends and extensive monitoring during the week.

Prosecutors say O’Neill was driving the wrong way when she struck and killed a Massachusetts women driving drunk.

A Tampa woman was sentenced to 15 years in prison after pleading guilty to DUI manslaughter.

A Hillsborough circuit judge didn’t believe 23-year-old Natalie Rodriques when she said at a hearing Monday that she didn’t know she had hit anyone. Authorities say Rodriques was driving with a blood alcohol level of 0.13% in March 2007 when she hit 16-year-old Irvin Eppy Soto Jr. Rodriques drove nearly a mile before crashing her pickup into a ditch. Records show she also had traces of cocaine, marijuana and Xanax in her system.

Records show Rodriques had already been arrested for driving under the influence two months earlier.

Rodriques will face 10 years of probation after being released from prison. Also, she can never again drive in Florida.
