Trial Date Set For Las Vegas Cop Accused of DUI After Violent Crash

The Former NHP sergeant accused of causing a deadly crash over the summer will be indicted by a grand jury.

Edward Lattin is accused of smoking marijuana off-duty and slamming his pickup into a car at Rainbow and Hacienda.

One person died and two people were injured.

The trial is scheduled to start in May.

Thomas Jane’s Kern County, California DUI Deal

Thomas Jane was sentenced to one year probation after pleading no contest to driving under the influence in California. The star of ‘Punisher’ was arrested after a traffic stop in Shafter, California last March after doing 120 mph in his Maserati. Jane must also pay a fine and enroll in an alcohol education program.

In exchange for the plea involving the misdemeanor drunk driving offense, the prosecution dropped charges of possession of a controlled substance without a prescription and having a blood-alcohol content above the legal limit. Jane, 39, had two outstanding speeding tickets from earlier in the year in Kern County that were also resolved.

In addition to his role in 2004’s ‘Punisher’, Jane appeared in last year’s movie ‘The Mist’. He is married to Patricia Arquette, actress in the television series ‘Medium’.

Heather Locklear Gets Santa Barbara DUI

Heather Locklear was charged with DUI in Santa Barbara County Saturday afternoon.

Locklear was reportedly arrested by the California Highway Patrol in Montecito after someone witnessed the actress driving erratically.

A Highway Patrol officer found Locklear’s car stopped on a state highway, blocking one lane. In talking with her, the officer determined that she was operating a vehicle while impaired. Locklear was taken to a nearby police station where she was tested for alcohol and drugs.

Locklear, 47, checked into a medical clinic last June for treatment of anxiety and depression.

Locklear has had roles in a number television series, including ‘Dynasty’, ‘Melrose Place’, ‘T.J. Hooker’ and ‘Spin City’, She has also appeared in movies, including ‘Uptown Girls’.

A California DUI charge can turn an accused drunk driver’s life to ruins. The accused driver is suddenly required to understand the California criminal court system and act quickly to protect his or her California driver’s license.

California DUI arrests trigger two separate cases: In court, and at the Department of Motor Vehicles (DMV). Although both cases are extremely serious, the DMV case is far more time-sensitive.

Motorists accused of drunk driving in California have only 10 days from the date of their DUI / DWI arrest to request a hearing with the DMV.

The criminal case filed against California DUI defendants consists of two different statutes: California Vehicle Code Section 23152 (a), and Vehicle Code Section 23152 (b).

The first count focuses on whether the driver was under the influence of alcohol or drugs to the extent that they are “unable to drive their car with the same caution characteristic of a sober person, of ordinary prudence, under the same or similar circumstances.” This is the legal standard for being considered under the influence of alcohol or “DUI” in California courts.

The second count, known as the “per se” charge, concentrates on whether the driver’s blood alcohol content (BAC) was .08 percent or greater. Based purely on body chemistry.

Even motorists licensed in other states who are arrested for DUI / DWI in California must request a California DMV hearing to protect their driving privileges.

California is one of 45 states that participate in the Interstate Driver’s License Compact, an agreement to share information about DUI or DWI convictions and driver’s license actions with other member states.

California has a DUI / DWI “washout” period of 10 years, calculated from arrest date to arrest date. This means that anyone arrested for drunk or drug driving within 10 years of the last arrest date will be charged with a second offense, with increased penalties and punishment.

The punishment in court for a second or third drunk driving conviction is much harsher than for a first offense – a multiple-offense drunk driving conviction carries mandatory jail time, an 18-month alcohol education program, a required ignition interlock device (such as Smart Start), and more.

2 Visalia DUI checkpoints nab 10 drivers

Ten people were arrested on suspicion of drunken driving at two DUI checkpoints in Visalia Friday and Saturday nights.

On the first night, seven people were arrested on suspicion of drunken driving. On the second night, there were three arrests.

Fifteen field sobriety tests were administered on Friday night, 19 vehicles were towed and 17 tickets were issued to unlicensed drivers or those driving on a suspended license.

On Saturday, the Visalia Police Department administered six field sobriety tests, towed 24 vehicles and cited 25 drivers for being without a license or driving on a suspended license.

Federal highway grant funded checkpoint

The checkpoint was funded through a grant from the National Highway Safety Administration.

More than a dozen citations were issued for other offenses.

The program is designed to reduce the number of people killed or injured in drunken-driving accidents as well as to educate the public on the dangers of impaired driving.

Craig Robinson was caught Driving Under the Influence with drugs in vehicle.

Craig Robinson, actor on the NBC show ‘The Office’ was charged with driving under the influence on June 29 following a traffic violation in Culver City, California. In addition to determining Robinson was under the influence of amphetamines, cocaine and marijuana, officers found ecstasy and methamphetamines in his vehicle.

Robinson, 36, was charged with two felonies and misdemeanor California DUI. He is scheduled to be arraigned August 21.

Robinson plays the warehouse foreman Darryl Philbin on ‘The Office’, and he has a role in the recently released stoner comedy ‘Pineapple Express”.

Woman faces manslaughter, DUI charges in motorcyclist’s death

A woman whose car collided with a motorcyclist last week, killing him, now is suspected of a homicide, authorities said Sunday.

After the head-on collision Thursday evening on Carson Road in Camino, Melissa Nicole Nichols, 23, was booked into El Dorado County Jail on Friday on suspicion of vehicular manslaughter, authorities said.

California Highway Patrol investigators said Nichols and Anthony James Payne, 23, had been dating. A passerby saw them talking to each other on Carson Road, near East County Road, about 7:45 p.m. Thursday. Nichols was driving a 2004 Pontiac Grand Am, and Payne was on a Honda 1000 motorcycle.

After the conversation, they departed in different directions but, at some point, investigators say, Payne evidently turned his motorcycle and came back westbound toward Nichols. For some reason, her car drifted into that lane and crashed into the motorcycle head-on.

The impact threw Payne about 200 feet, and he was pronounced dead at the scene.

“Investigators from the California Highway Patrol and our agency met for a long time Friday afternoon to discuss it,” Sgt. Phil Chovanec, El Dorado County sheriff’s spokesman, said Sunday.

Investigators also interviewed a passenger who was with Nichols and developed other evidence that they felt supported a manslaughter count, Chovanec said.

The sheriff’s office is now the lead agency for the continuing investigation, but CHP investigators remain involved in the case, Chovanec said.

Nichols was transported to Sutter Roseville Medical Center with minor injuries after the wreck. On Friday, she was returned to Placerville and booked into jail on suspicion of vehicular manslaughter while intoxicated and drunken driving resulting in bodily injury.

Anderson DUI Patrol More Active than Ever

Anderson Police Department announced Thursday that it would take part in patrols for drunk drivers across Anderson, Redding and Shasta Lake City from Aug. 15 to Sept. 1 through the Shasta County Avoid the 5 program.

“Basically, it’s a one-man patrol unit to look for DUIs (driving under the influence),” said APD Captain Robert Kirvin.

“For whatever reason, we have a high level of incidents during this time period,” CHP Public Affairs Officer Steve Rauch said. “There are a lot of folks travelling at the end of summertime, going out on the weekends, and adding alcohol to that.”

The extra patrol would look specifically for impaired drivers in Anderson from 7 p.m. to 3 a.m. Kirvin added that although the grant requires that the extra patrolman be used only for DUI patrol, the officer could be relied on in any emergency.

The Avoid the 5 program is funded by a grant from the California Office of Traffic Safety through the National Highway Traffic Safety Administration.

“The AVOID Anti-DUI Program was launched in 1973 to bring law enforcement agencies together in county-wide clusters to crack down on the drinking driver and reduce the number of deaths and injuries caused by alcohol related crashes,” states the California Avoid Web site.

Mischa Barton Hates Drunk Drivers

Actress disgusted with her California DUI in Los Angeles.

In a recent interview Mischa Barton has said that she was disgusted with herself following an arrest for driving under the influence in LA. She went on to say, “The thing is, I hate drunk drivers. Living in L.A., I can’t stand them.”

The former star of the television show ‘The O.C.’ said that she wanted to prove to the court that she took the incident seriously and that she was not an alcoholic who might repeat the drunk driving offense by entering rehab. While Barton believes that going to rehab helped her avoid more serious penalties, she plead guilty to California DUI and received a three year probation sentence before deciding to seek help.

Barton was arrested for DUI in LA last December. She entered her guilty plea in April and was relieved when the charge of marijuana possession was dropped.
