Knox prosecutor set to appear on DUI charge Tuesday
A Knox County prosecutor is set to appear in Anderson County court Tuesday–this time as a defendant.
Kevin Allen is charged with driving under the influence and violation of the implied consent law. Oak Ridge Police Officer Philip Nall said Allen refused a sobriety test.
Allen, 44, was arrested just before 1:30 a.m. Saturday morning in Oak Ridge.
Nall wrote in his narrative that Allen was driving erratically and once pulled over either did not respond to questioning or was slow to answer.
The Affiant, an Oak Ridge Police Officer, observed a white 1999 Ford Explorer travelling northbound on Melton Lake Drive in an erratic manner. The vehicle was first noticed as it rounded the curve near Union Valley Rd where the right side tires left the roadway causing dust to swirl up around the vehicle. Continued observation of the vehicle saw it drive from centerline to fogline several times, making wdie right turn into the wrong lane of travel on Dana Dr and drift left side tires across the center line near Carnegie Dr.
After a stop was initiated on the vehicle, the driver was identified as the Defendant, Kevin J Allen. He either did not respond to questioning or was slow to produce an answer. He smelled of alcohol and did admit to consuming beer earlier in the evening. His speech was slow and slurred, his face flushed and eyes watery. Allen refused to submit to any field sobriety testing.
This occuring on a public roadway in Oak Ridge, Anderson County Tennessee, in violation of TCA 55-10-401.
Allen is due to appear in court at 9 a.m. Tuesday morning.

A Knox County prosecutor is out of jail after being arrested on drunken driving charges.
According to the Oak Ridge Police Department, Kevin Allen was arrested at 1:19 a.m. Saturday.
He left the Anderson County Jail several hours later after posting a $5,000 bond.
Allen is charged with DUI and failing to submit to a breathalyzer test.
